  • “Compost Drop-Off Data” means specific subset of Platform Data relating to compost drop off location, facilities, programs, collection points, addresses, coordinates, accepted materials, operating details, categories, filters, tags, notes, search results, map markers, source notes, metadata, summaries and related information displayed through or used by any compost drop-off map, finder, directory, facility search tool, routing feature, downloadable resource, API or similar Platform Tool.

Scope of These Terms and Conditions

These Terms and Conditions apply to:

  • Website tools and data products;
  • Maps, trackers, dashboards, databases, calculator and reports;
  • Product catalogue pages;

Without prior written permission, you must not copy, scrape, extract , download, store, cache, reproduce, republish, display, distribute, sell, license, sublicense, benchmark, train on, integrate, embed, mirror, use as a data source for or otherwise exploit any compost drop-off listings, facility information, location data, coordinates, categories, accepted material information, tags, filters, map markers, search results, notes, summaries, metadata, or related Platform Data made available through the Website.

This includes using Compost Drop-Off Data to create, operate, support, improve, verify, populate or update any compost drop-off finder, facility directory, facility map, location search tool, marketplace, routing tool, lead-generating platform, subscription database, analytics product, AI systems, report, data product, or other service that is similar to, competitive with or a substitute for any Better Earth Platform Tool.

Permissions, Licensing and Commercial Use

If you wish to use our Platform Tools and Platform Data for commercial and non-commercial purposes, you will need explicit written permission from us. This includes use for

  • Client reports or consultancy deliverables
  • API Access
  • Data licensing

Injunctive Relief

Each party will bring claims only in its individual capacity and not as a plaintiff, class member or representative in any class, collective, consolidated or representative proceeding, to the fullest extent permitted by law.

Severability

If any provision of these Terms and Conditions is found to be invalid, illegal or unenforceable, the remaining provisions will remain in full force and effect, and the invalid, illegal or unenforceable provision will be enforced to the maximum extent permitted by law or modified to achieve its intended effect as closely as possible.

Our failure to enforce any provision of these Terms and Conditions does not waive our right to enforce that provision or any other provision later.
