Interpretation

“Compost Drop-Off Data” means specific subset of Platform Data relating to compost drop off location, facilities, programs, collection points, addresses, coordinates, accepted materials, operating details, categories, filters, tags, notes, search results, map markers, source notes, metadata, summaries and related information displayed through or used by any compost drop-off map, finder, directory, facility search tool, routing feature, downloadable resource, API or similar Platform Tool.

Scope of These Terms and Conditions

These Terms and Conditions apply to:

General website browsing;
Website tools and data products;
Maps, trackers, dashboards, databases, calculator and reports;
Product catalogue pages;
Product images, descriptions, specifications, certifications and pricing displays;
E-commerce browsing and account features;
User submissions, reviews, feedback and inquiries;
Website security, anti-scraping controls and access restrictions; and
All other website features unless separate terms apply

Platform Tools, Data Products and E-Commerce Content

Product listings, product catalogues and product comparison tools;

Reports, summaries, guides, datasets and downloadable resources; and
Trackers, databases, maps, directories, dashboards, or digital resources that we create at a later date

Collectively, these will be referred to as “Platform Tools” as defined within Section 2.

Permitted Use

You may use the website for lawful, personal, educational, informational, shopping and internal business reference purposes.

Use Platform Tools through the normal website interface

This is a limited permission. It does not allow scraping, bulk copying, republication without permission, resale, commercial reuse without permission, embedding, AI training, Catalogue copying, product data extraction or use in a competing product or service.

Where we allow attribution, citation, source notes and link, that attribution is for identification only and does not grant any license or permission to copy, scrape, extract, download, store, reproduce, republish, display, distribute, sublicense, sell, commercialize, train on or create derivate works, databases, maps, directories, tools, products, reports or services from our Website, Platform Tools or Platform Content.

Attribution to Better Earth LLC does not make, an otherwise unauthorized use permitted. Any use not expressly allowed in these Terms and Conditions requires our prior written permission.

Intellectual Property Rights

We own or license the rights to our Platform Data. This includes rights in:

Website text, images, graphics, reports, guides, videos, documents and all visual content;
Our name, branding, logos, trademarks and service marks;
Website layout, structure, templates and user interface;
Software, scripts, source code, workflows, APIs and technical configuration;

Any original research, commentary, analysis, reports, outputs or material we create.

You do not receive ownership of our Platform Data by using the website. All rights not expressly granted are reserved.

Ask, instruct, pay or allow someone else to do any of the above.

These restrictions apply whether the data is collected manually, automatically or through browser tools, through cached files, through screenshots, through third-party tools, through artificial intelligence systems, or by any other method.

Embedding, Republication and Misrepresentation

Unless we give explicit written permission, you must not:

Display our Platform Data on another website, app, intranet, dashboard, map, database, marketplace, catalogues, or service.
Frame, iframe, embed, mirror, proxy, stream, link or rehost our website, Platform Tools and Platform Data.
Make a Platform Tool, appear as though it is part of your own website, product or service.

Compost Drop-Off Data Usage and Handling

Without prior written permission, you must not copy, scrape, extract , download, store, cache, reproduce, republish, display, distribute, sell, license, sublicense, benchmark, train on, integrate, embed, mirror, use as a data source for or otherwise exploit any compost drop-off listings, facility information, location data, coordinates, categories, accepted material information, tags, filters, map markers, search results, notes, summaries, metadata, or related Platform Data made available through the Website.

This includes using Compost Drop-Off Data to create, operate, support, improve, verify, populate or update any compost drop-off finder, facility directory, facility map, location search tool, marketplace, routing tool, lead-generating platform, subscription database, analytics product, AI systems, report, data product, or other service that is similar to, competitive with or a substitute for any Better Earth Platform Tool.

Permissions, Licensing and Commercial Use

If you wish to use our Platform Tools and Platform Data for commercial and non-commercial purposes, you will need explicit written permission from us. This includes use for

Embedding
Commercial research
Client reports or consultancy deliverables
API Access
Data licensing
Product catalogue licensing
Product integrations
AI or Machine Learning use
Benchmarking
Derived databases
Dashboard or trackers
Product comparison tools
Marketplace listings
Media usage
Any other use that generates value from our Platform Data

If you copied, scraped, extracted, republished, resold or misused our Platform Tools and Platform Data, without permission, you must immediately stop using them and delete and dispose all copies, extracts, caches, backups, spreadsheets, datasets, derivate works, reports, outputs, models, embeddings, indexes, product catalogues and republished versions.

Injunctive Relief

You acknowledge that unauthorized scraping, copying, extraction, use, republication, resale, embedding, AI training, model development reverse engineering or misuse of the website, Platform Tools and Platform Data may cause immediate and irreparable harm to Better Earth LLC for which monetary damage alone may be inadequate.

You agree that Better Earth LLC may seek temporary, preliminary and permanent injunctive relief, specific performance and other equitable remedies without the need to prove actual damages or post a bond, to the fullest extent permitted by law.

Availability

We do not guarantee uninterrupted, secure or error free availability of our Website, Platform Tools and Platform Data at all times.

Limitation of Liability

The arbitration will take place in DeKalb County, Georgia, unless the parties agree otherwise in writing. The arbitration will be conducted in English by one arbitrator. The arbitrator may award any relief available in court, subject to the limitations and exclusions in these Terms and Conditions.

Each party will bring claims only in its individual capacity and not as a plaintiff, class member or representative in any class, collective, consolidated or representative proceeding, to the fullest extent permitted by law.

Severability

If any provision of these Terms and Conditions is found to be invalid, illegal or unenforceable, the remaining provisions will remain in full force and effect, and the invalid, illegal or unenforceable provision will be enforced to the maximum extent permitted by law or modified to achieve its intended effect as closely as possible.

Our failure to enforce any provision of these Terms and Conditions does not waive our right to enforce that provision or any other provision later.
